Radical Civic Union (UCR) deputies in Buenos Aires province have launched a legislative bid to ban the sale and distribution of e-cigarettes. Led by Representative Alejandra Lordén, the proposed law directly challenges the national deregulation of vaping products recently promoted by President Javier Milei’s administration.
The provincial initiative seeks to completely block the marketing, distribution, import, and advertising of electronic devices. It serves as an open challenge to Resolution 549/2026, issued by the Ministry of Health and ANMAT, which relaxed restrictions on vapes nationwide.
To highlight the urgency of the situation, provincial deputies pointed to statistics from the state agency SEDRONAR. The data reveals that 35.5% of secondary school students aged 13 to 17 consume electronic cigarettes, making vapes one of the most widely used substances in this age group.
“We are facing a health problem that is silently advancing among our youth,” stated Alejandra Lordén, warning of severe respiratory, cardiovascular, and neurological risks associated with early vape use.
National vs. Proposed Provincial Vape Policies
| Policy Aspect | National Policy (Resolution 549/2026) | Proposed Buenos Aires Provincial Bill |
|---|---|---|
| Sales & Distribution | Deregulated / Allowed | Strictly prohibited across the province |
| Digital Advertising | Permitted under national guidelines | Banned on social media, streaming, and via influencers |
| Enforcement Power | National health authorities | Delegated to local mayors and provincial ministries |
Beyond sales, the bill heavily targets digital marketing. It proposes a total ban on vape promotions across social media, streaming platforms, and influencer channels, alongside a ban on e-commerce sales within the province.
Violators would face multimillion-dollar fines, business closures, and product seizures. Under the draft law, all funds collected from these fines would be legally designated for adolescent health and addiction prevention programs.
While the bill grants local mayors and ministries the power to seize and destroy illicit vaping merchandise, its future remains uncertain. The initiative must first navigate a highly polarized Buenos Aires legislature currently stalled by internal political conflicts.
