Regulating Nicotine Pouches and Future Products
The update amends the original 1995 statutory framework rather than creating entirely separate legislation. Lawmakers structured the law to cover product categories that previously operated outside traditional tobacco regulations, such as modern nicotine pouches.
The statutory definition for tobacco-free nicotine products was intentionally drafted broadly. This approach ensures that current items, as well as future nicotine-containing market innovations, remain subject to strict legal oversight.

While the primary objective centers on shielding children and adolescents from appealing disposable products, public health observers note the legislation offers limited new support mechanisms for the roughly 20 percent of the Austrian population who smoke daily.
