The state government of Baden-Württemberg has confirmed a major update to its Non-Smoker Protection Act, set to take effect on June 1, 2026. Designed to shield children and young people from the dangers of secondhand smoke, the new regulation bans smoking and vaping in popular outdoor leisure and transit areas.
The policy shift comes amid growing health concerns. According to the Federal Statistical Office, approximately 19% of individuals aged 15 and older in Germany smoked in 2025, marking a worrying upward trend in youth smoking compared to 2021.
To curb this rise and protect public health, authorities are targeting high-traffic areas where children gather. Under the new rules, smoking is banned at:
- Playgrounds and amusement parks
- Zoos and botanical gardens
- Outdoor swimming pools (Freibäder)
- Public transport stops and stations
Enforcement will be strict. Anyone caught violating the ban will face an immediate €200 fine. For repeat offenders caught a second time within a twelve-month period, the penalty escalates significantly, reaching up to €500.
