A new era for vaping regulation has begun in Chile with Law 21.642 taking effect this Tuesday. After more than four years of congressional discussion, the legislation aims to curb the indiscriminate use and sale of electronic cigarettes, applying to both nicotine and non-nicotine containing products.
Key provisions of the new law include a strict prohibition on the sale of all vaping products to individuals under the age of 18. Furthermore, the law mandates that e-cigarettes must now carry clear health warnings on their packaging, similar to those required for traditional tobacco products. Advertising for vapes faces significant restrictions, limiting how and where these products can be promoted to the public.
The legislation also governs the display of e-cigarettes at points of sale, prohibiting conspicuous or flashy showcases. Additionally, product displays are not permitted near schools or health centers. The Ministry of Health has emphasized that these measures aim to underscore that vaping is not without health risks and should be treated with the same caution as conventional cigarettes. This new regulatory framework signals a significant step by Chile to control the e-cigarette market and protect public health, especially among its younger population.
